T3WEB terms and conditions

The terms under which we provide audits, new websites, upgrades and the CARE subscription: price, deadlines, acceptance, hosting and termination.

English translation for your information. In case of any discrepancy, the Slovak version applies.

These terms and conditions govern the T3WEB services: website audits, new websites and portals, the takeover and upgrade of TYPO3 websites and the CARE subscription. They supplement the General Terms and Conditions of AWIS group, s. r. o. (in Slovak; hereinafter the “GTC”).

Art. 1 Introductory provisions

  1. The services are provided by AWIS group, s. r. o., with its registered office at Závodská cesta 2945/38, 010 01 Žilina, Slovakia, Company ID 45 971 943, Tax ID 2023163560, VAT ID SK2023163560, registered in the Commercial Register of the District Court Žilina, Section Sro, File No. 62487/L (hereinafter the “Provider”).
  2. These terms apply to entrepreneurs and legal entities (B2B). Matters not covered by them are governed by the GTC. Where they deviate from the GTC, these terms take precedence; a contract or a confirmed price offer takes precedence over them.

Art. 2 Definitions

  • T3WEB – the Provider’s library of elements and templates for the TYPO3 content management system on which the Provider builds websites.
  • Audit – a free assessment of a website based on its publicly available parts.
  • Project – a new website or portal (WEB, WEB+ and PORTAL packages).
  • Upgrade – the takeover of an existing TYPO3 website and its migration to the current version (S, M and L packages).
  • CARE – a subscription for hosting, updates and website care (Basic, Business and Pro packages).
  • LTS version – a TYPO3 version with long-term support for which security fixes are released.
  • Staging copy – a non-public copy of the website used to verify changes before publication.

Art. 3 Website audit

  1. The audit is free of charge and does not oblige the client to place an order.
  2. During the audit, the Provider examines only publicly available parts of the website. It does not log in to the administration or the server.
  3. The Provider sends the report by email, as a rule within 2 working days of receiving the request.
  4. The report is indicative. The binding scope, price and deadline are set out in the price offer. If necessary, the Provider may, with the client’s consent, look into the website administration before making the offer.

Art. 4 Projects and upgrades

  1. Projects and upgrades are carried out on the basis of a price offer with a fixed price, scope and deadline. “From” prices stated on the website are indicative. The offer is valid for 30 days.
  2. Unless the offer states otherwise, 50 % of the price is invoiced after the order and 50 % after the website is launched. Invoices are payable within 14 days.
  3. The Provider works on a staging copy. The client approves the design and content before the launch.
  4. The client may comment on the delivered website within 5 working days. If the client does not respond within this period or launches the website, the website is deemed accepted. The Provider handles defects discovered later in accordance with Art. 13 of the GTC.
  5. In an upgrade, the Provider transfers texts, images and the page structure to T3WEB elements and redirects old URLs to the new ones. Third-party extensions that do not exist for the current TYPO3 version are replaced with T3WEB elements, or the Provider offers a solution for them separately.
  6. The Provider plans the launch (switching the domain) so that the website remains available.
  7. The Provider carries out work beyond the scope of the offer only after the client’s approval and charges it at the hourly rate stated in the offer.
  8. The client supplies texts, materials and access within the agreed deadlines. If the client fails to cooperate, deadlines are extended by the period of delay (Art. 7 of the GTC).

Art. 5 CARE subscription

  1. The scope of the Basic, Business and Pro packages (hosting, SSL certificate, security updates of TYPO3 and PHP, backups, monitoring, response times, hours included and the hourly rate) is stated in the price list on this website.
  2. The website runs on the Provider’s server in a data centre in the European Union. Backups are made daily and kept according to the package.
  3. The move to the next TYPO3 LTS version is included in all CARE packages for websites built on T3WEB elements. The Provider carries it out before the end of security support for the version the website runs on. Custom-developed elements and third-party extensions that are not part of T3WEB are adapted during the move at a price agreed separately.
  4. Response times apply on working days from 8:00 to 17:00 Central European Time and are stated in the price list. A response time is not a guarantee of resolution within that time.
  5. Hours of changes included (CARE Pro) are counted in started 15-minute units and do not carry over to the next month. Other work is charged at the package’s hourly rate; the Provider agrees work exceeding 2 hours with the client in advance.
  6. CARE is invoiced monthly in advance, or yearly in advance for 10 months.
  7. The CARE contract is concluded for an indefinite period, with no minimum term. The notice period is 1 month and starts on the first day of the month following delivery of the notice. With yearly payment, the contract ends at the end of the paid period and the amount paid is not refunded.
  8. After CARE ends, the Provider hands over the website files, database and access details to the client or a new supplier within 10 working days.

Art. 6 Use of the website and content

  1. TYPO3 is open-source software licensed under the GNU GPL. TYPO3 is a trademark of the TYPO3 Association; T3WEB is not affiliated with it.
  2. After paying the price of the project or upgrade, the client may use the T3WEB elements in their website without time limitation, even after the CARE subscription ends.
  3. Texts, images and other content supplied by the client remain the client’s. The client is responsible for having the right to use them.

Art. 7 Personal data protection

  1. When hosting and maintaining the website, the Provider processes personal data controlled by the client (e.g. messages from forms) as a processor under Art. 28 GDPR. The parties conclude a data processing agreement for this purpose.
  2. The Provider processes data from the audit form in accordance with the Privacy policy page.

Art. 8 Final provisions

  1. Liability for damage, complaints, confidentiality and other matters are governed by the GTC.
  2. The Provider may change these terms. It will notify clients with a CARE subscription of a change at least 30 days in advance; if the client does not agree, the client may terminate CARE in accordance with Art. 5.
  3. These terms take effect on the day of their publication on this website.
